Name: Consideration of an Emergency Ordinance amending all sections of the City’s Municipal Code Title 8, Chapter 8.32, Fire Code (Second reading)

Description: Changing the Municipal Code to reflect the mandates as required by the State of California will allow the City to continue to enforce the City of Carmel Fire Code and will keep the code current and compliant with the 2007 International Fire Code, including the appendix Chapter 1 and Appendices A, B, C and D, published by the International Code Council.

Staff Recommendation: Adopt the Ordinance.

Important Considerations: To stay current with the 2007 International Fire Code.
Decision Record: City Council has updated Title 8, Chapter 8.32 in 2001 and 2003. The
Ordinance was adopted on First Reading by the Council at its January 8, 2008 meeting.

SUBJECT: CONSIDERATION OF AN ORDINANCE AMENDING THE CITY’S MUNICIPAL CODE TITLE 8, CHAPTER 8.32, ALL SECTION FIRE CODE.

RECOMMENDED MOTION
Adopt the proposed ordinance.

BACKGROUND
In 2001 and in 2003, the Municipal Code of the City of Carmel-by-the-Sea was amended in its entirety to reflect the International Fire Code as mandated by the State of California. The 2007 Fire Code is now in effect and the Municipal Code should reflect the mandated changes. Changing the Municipal Code to reflect the mandates as required by the State of California will allow the City to continue to enforce the City of Carmel Fire Code with minor changes and be in compliance with 2007 International Fire Code.

If the ordinance and above State mandates are not adopted, it will render the City of Carmel-bythe- Sea’s Fire Code unenforceable and the City will be forced to use a Fire Code that does not reflect regulations currently in the Municipal Code.

FISCAL IMPACT
No fiscal impacts to the City are anticipated.

ORDINANCE NO. 2008-____

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA ADOPTING THE 2007 UNIFORM FIRE CODE AND AMENDING CHAPTER 8.32 OF THE CARMEL MUNICIPAL CODE

WHEREAS, the Uniform Fire Code was amended in its entirety in 2001 and 2003 to
reflect the international Fire Code as mandated by the State of California; and
WHEREAS, the State of California has updated the Uniform Fire Code in its entirety to
reflect the new 2007 mandates; and

WHEREAS, Chapter 8.32 of the Carmel Municipal Code should reflect the State of
California mandates as required by the 2007 Uniform Fire Code.

THEREFORE, THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA DOES HEREBY ORDAIN AS FOLLOWS:

Section One. Chapter 8.32 of the Municipal Code of the City of Carmel-by-the-Sea is
amended in its entirety as shown in Exhibit “A”, attached hereto and incorporated herein.

Section Two. Severability. If any section, subsection, or part of this Ordinance is held to be invalid or unenforceable, all other section, subsections, or parts of subsections of this ordinance shall remain valid and enforceable.

Section Three. Effective Date. This Ordinance shall take effect thirty (30) days after final adoption.
