REGULAR MEETING MINUTES
Thursday, March 1, 2012
1:30p.m.

I. CALL TO ORDER AND ROLL CALL

The regular meeting of the Forest and Beach Commission of the City of Carmel-by-the-Sea, California was
held on the above date at the hour of 1:34 p.m. The meeting was adjourned to the tour of inspection and
reconvened the meeting at 2:22 p.m.

STAFF PRESENT: Mike Branson, City Forester
Margi Perotti, Secretary to the Forest and Beach Commission

II. PLEDGE OF ALLEGIANCE

Members of the audience joined the Commission in the Pledge of Allegiance.

III. APPEARANCES

Neils Reimers, Kathy Haller and Mr. William Smith appeared before the Commission.

IV. CONSENT AGENDA

1. Consideration of the minutes for the 2 February regular meeting.

It was agreed by unanimous consensus to approve the minutes of the 2 February 2012 regular meeting with
one correction.

V. APPLICATIONS/PUBLIC HEARINGS

1. Consideration of an application to remove ten coast live oaks (2-6", 4-4", 2-3" 1-7'', 1-8") for construction of a new home. The site is located on the east side of Mission Street, 3 north of 8th
Avenue. The applicant and property owners are James and Catherine Bell.

Mike Branson, City Forester presented his staff report.

Chairperson LEVERONE opened the public hearing at 2:56 p.m. Richard Barrett, project architect and Jim
Bell, property owner, appeared before the Commission. The public hearing was closed at 2:58 p.m.

It was moved by RUFUERZO and seconded by LEVERONE to approve the application with staffs special
conditions. The motion carried by the following roll call vote:

AYES: COMMISSION MEMBERS: BOARDMAN, KADIS, REFUERZO, LEVERONE
NOES: COMMISSION MEMBERS: NONE
ABSTAINED: COMMISSION MEMBERS: NONE
ABSENT: COMMISSION MEMBERS: HORNIK

2. Consideration of an application to remove one Monterey pine (28" diameter) due to safety concerns
of the property owner. The site is located on the northwest comer of Carpenter Street and Second Avenue.
The applicant is Smith Tree Service for property owner Mrs. Lawton.

Mike Branson, City Forester presented his staff report.

Chair LEVERONE opened the public hearing at 3:04 p.m. Brian Jacobson, from Smith Tree Service
appeared before the Commission. The public hearing was closed at 3:06 p.m.

It was moved by RUFUERZO and seconded by KADIS to approve the application. The motion FAILED by the following roll call vote:

AYES: COMMISSION MEMBERS: KADIS, REFUERZO
NOES: COMMISSION MEMBERS: BOARDMAN, LEVERONE
ABSTAINED: COMMISSION MEMBERS: NONE
ABSENT: COMMISSION MEMBERS: HORNIK

It was moved by LEVERONE and seconded by BOARDMAN to deny the application. The motion failed by the following roll call vote:

AYES: COMMISSION MEMBERS: BOARDMAN, LEVERONE
NOES: COMMISSION MEMBERS: KADIS, REFUERZO
ABSTAINED: COMMISSION MEMBERS: NONE
ABSENT: COMMISSION MEMBERS: HORNIK

This item was continued to the next meeting for consideration by the entire commission.

V. ORDERS OF BUSINESS

1. Discussion on the progress of the Ad Hoc committee and questions to the City Attorney regarding the
monitoring of replacement trees for five years.

Chair LEVERONE gave a presentation and introduced Don Freeman, City Attorney.

City Attorney comments:

Ensuring compliance- might not issue permit until you receive drawing where tree plating is to occur.

Volunteers- has legal liability to the City. Would need permission from the property owner or inspection
warrant to go on private property. We must do background checks for volunteers who would go onto the property.

Is there a problem with replacement trees- go back 1 or 2 years and double check to see if the required trees are there.

Bonds -legal process with court order. Not worth the money- would have to do a court process to get the
money within the state of California. Legal liability to the City.

Deed restricts - must have a date to end the deed restriction - ordinance thru the city council and want to put
a deed restriction on a property

Don feels education is the best method. Also, the water crisis might limit the homeowner's ability to plant
and water the tree for 5 years. Financially a burden too.

Is it city wide or an individual problem?
City wide issue - obtain deed restriction.
Checking - no volunteers, it is city staff responsibility.
Ordinance change- give applicants a drop date to have the tree planted. Date certain, and it must be
inspected on that day.

Public comment open and closed at 2:44 p.m.

After discussion the commission decided to discuss at the next regular meeting a draft of an ordinance to
address having a replanting map , required planting date and required inspection date as part of issuance of a
tree pruning/removal permit.

Also, at some future meeting to discuss the possibility of deed restrictions and possibly implementing an in
lieu fee for not planting a tree.

2. Discussion of Commission goals for budget consideration in FY 2012-13.

Commissioner REFUERZO presented the Ad Hoc goals for the Commissions FY 2012-13 goals under three categories:

A. Urban Forest and Parks

Chair LEVERONE opened the public hearing, no appearances, the public hearing was closed

B. Mission Trail Nature Preserve.

Chair LEVERONE opened and closed the public hearing.

C. Carmel Beach

Chair LEVERONE opened the public hearing, Kathy Haller and Greg D'Ambrosio appeared before the
Commission.

Following discussion, it was moved by LEVERONE and seconded by REFUERZO to forward the Commission budget requests as revised to the City Council for consideration. The motion carried by the
following roll call vote:

AYES: COMMISSION MEMBERS: BOARDMAN, KADIS, REFUERZO, LEVERONE
NOES: COMM:ISSION MEMBERS: NONE
ABSTAINED: COMM:ISSION MEMBERS: NONE
ABSENT: COMMISSION MEMBERS: HORNIK

3. Discussion on scheduling a workshop with the Planning Commission to review and discuss tree
protection policy, city codes, and possible implementation of any amendments.

Chair LEVERONE opened the public hearing at 4:01 p.m. Steve Brooks and Greg D'Ambrosio appeared
before the Commission. Public comment closed at 4:03 p.m.

Chair LEVERONE continued this item to the next regular meeting.

No other action taken.

4. Review and comment on the design of a new footbridge for Mission Trail Nature Preserve.

Mike Branson, City Forester presented his staff report and addressed questions from the Commission.

Chairperson LEVERONE opened the public hearing at 4:07 p.m. Greg D'Ambrosio appeared before the
Commission. The public hearing was closed at 4:08 p.m.

It was moved by LEVERONE and seconded by Commissioner KADIS to approve the similar structural
design of the new (2009) bridge, to make the bridge ADA compliant, and no mid-span landing area. The
motion carried by the following role call vote:

NOES: COMMISSION MEMBERS: NONE
ABSTAINED: COMMISSION MEMBERS: NONE

5. Discussion on the Maintenance and Inspection section of the Shoreline Management Plan.

Chairman LEVERONE spoke on the importance of the Shoreline Management Plan.

Mike Branson, City Forester addressed use of the Plan by the Ad hoc beach committee and all commissioners when reviewing or planning beach activities.

Chairperson LEVERONE opened the public hearing at 4:12p.m. Cathy Haller appeared before the
Commission. Public hearing was closed at 4:13 p.m.

No other action taken

Vll. REPORTS FROM STAFF AND COMMISSION

1. Receive verbal report from the Ad Hoc Beach Committee.

Commissioner BOARDMAN stated the garbage cans are dirty and signage needs to be replaced.

Mike Branson, City Forester reported that Commissioner HORNIK submitted an email stating near 12th
Avenue there are two places where some cement needs to be repaired and an exposed pipe needs removal.
These items were forwarded to staff for appropriate repairs.

2. Forester's Report.

Mike Branson City Forester presented his report.

Chairperson LEVERONE opened the pubic hearing at 4:19p.m. Steve Brooks appeared before the
Commission. No action taken.

IV. ADJOURNMENT

There being no further business, Chairperson LEVERONE adjourned the meeting at 4:21 p.m.

I. CALL TO ORDER

II. ORDERS OF BUSINESS

1. Demonstration and receive public comment regarding the fire basket and charcoal removal. No action will be taken at this meeting. Further discussion will be at a subsequent Forest and Beach Commission Regular meeting.

If this meeting is cancelled due to rain, it will be held on Sunday, 11 March 2012 at 11:00 a.m.

WORKSHOP MEETING MINUTES
Saturday March 10,2012
1:30 p.m.

A workshop of the Forest and Beach Commission of the City of Carmel-by-the-Sea, California was held on
the above date at the hour of 11:00 a.m. on Carmel Beach at the Cove at Scenic and 13th Avenues.

I. CALL TO ORDER
PRESENT: Tom Leverone, Lisa Boardman and David Refuerzo

ABSENT: Todd Hornik, Les Kadis

STAFF PRESENT: Margi Perotti, Secretary to the Forest and Beach Commission

Comments from the pubic regarding the demonstration of the fire basket.

• Where would the baskets be available, how would they be returned.
• Will it cost to use the baskets? If so, how much will it cost?
• Will there be a deposit for the basket? If so how do they get their deposit back?
• How many fire baskets would be available, would people still be able to have fires if they don't have
baskets?
• Will buckets need to be dispensed with the baskets to haul water?
• Where would the charcoal be disposed?
• What are the fines if they dump the coals on the beach?
• What about the coals catching on fire, what are the preventative measures?
• Could hotels buy baskets and dispense them from the hotel?
• Are smaller baskets available for couple?
• What is the liability if someone get hurt hauling the basket up from the beach
• Would the City sell wood along with the use of the basket?
• Would the City pick the baskets up at the end of the evening with the A TV?
• What is the life span of the basket?
• Will the baskets be available for purchase if someone wanted to buy one?
• Will an ordinance need to be adopted to require the use of the baskets?
