Name: Consideration of a Resolution authorizing the submittal of a grant application in the amount of $2,500,000 to the State Water Board for projects associated with storm water runoff.

Description: The State Water Board has mandated that local government agencies discharging water into Areas of Special Biological Significance (ASBS) maintain compliance with monitoring measures for water quality and measures to protect the water quality within the ASBS. The City of Carmel-by-the-Sea is fully permitted to discharge storm water under the Monterey Regional Storm Water Management Plan and is awaiting a supplemental exception from the State Water Board to discharge into the ASBS. As part of the City’s compliance, extensive water monitoring and educational programs must be put in place and alternatives for diverting or treating the storm water runoff must be examined. The grant offered by the State will help offset costs associated with these compliance measures by assisting in completing planned and budgeted storm drain repairs, by allowing the City to investigate options for storm
water diversion, helping fulfill the public education requirements and by deferring some of the costs associated with participation in a regional monitoring effort.

Overall Cost:
City Funds: $125,000 - 5% match
Grant Funds: $2,500,000 (out of $34,000,000 available statewide)

Staff Recommendation: Approve the Resolution.

Important Considerations: The City will bear the entire financial burden of this unfunded mandate if the grant is not applied for/awarded.

Decision Record: $130,000 was approved the in budget for 08/09 and 09/10 for repairs to storm drains. Should the grant be awarded, this amount would be not be expended by the City for actual repairs, but could be used to cover the $125,000 match to facilitate the repairs as part of the designated grant projects.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA AUTHORIZING THE SUBMITTAL OF A GRANT APPLICATION IN THE AMOUNT OF $2,500,000 TO THE STATE WATER BOARD
FOR PROJECTS ASSOCIATED WITH STORM WATER RUNOFF

WHEREAS, the State Water Board has mandated compliance with regulations pertaining runoff into Areas of Special Biological Significance (ASBS); and

WHEREAS, the City of Carmel-by-the-Sea contributes to the runoff into ASBS 34, Carmel Bay; and

WHEREAS, the City must also comply with state regulations in order to maintain
its permit to discharge storm water runoff as part of the Monterey Regional Storm Water Management Plan; and

WHEREAS, the City recognizes the need to monitor runoff, analyze options for diversion and educate the public about runoff; and

WHEREAS, the City of Carmel-by-the-Sea will submit a grant application to State Water Board for storm drain repairs, dry and wet weather monitoring, public education and costs associated with the analysis of diversion options.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA DOES:

1. Approve the grant application for projects associated with storm water runoff.

2. Upon issuance of the grant monies by the State Water Board, authorize the expenditure of $80,000 from the 08/09 Capital Improvement Budget and $45,000 from the 09/10 Capital Improvement Budget designated for storm drainage improvements to pay for the 5% City match on the $2,500,000 grant.
