I. CALL TO ORDER
The special meeting of the City Council of the City of Carmel-by-the-Sea, California, was held on the above date at the stated hour of 4:35 p.m. Mayor McCloud called the meeting to order.

II. ROLL CALL
PRESENT: Council Members Hazdovac, Rose, Sharp, Talmage & McCloud
STAFF PRESENT: Rich Guillen, City Administrator
Heidi Burch, City Clerk
George Rawson, Public Safety Director

III. PLEDGE OF ALLEGIANCE
Members of the audience joined the Mayor and Council Members in the Pledge of
Allegiance.

IV. ORDERS OF COUNCIL
A. Consideration of a Resolution Certifying the Re-circulated Final Environmental Impact Report for the Sale of the Flanders Mansion Property.

B. Consideration of a Resolution Adopting a Mitigation Monitoring and Reporting Program, Conditions of Sale, A Declaration of Conditions, Covenants and Restrictions to Be Recorded against the Property, and Conditions of Lease.

C. Consideration of a Resolution Adopting a Statement of Overriding Considerations.

D. Consideration of a Resolution Adopting a Project for Implementation: Sale of Flanders Mansion Parcel with Conservation Easements and Mitigation.

E. Consideration of a Resolution of Notice of Proposed Discontinuance of Public Park Land and Setting Date for Hearing of Protests against Sale of Public Park Land.

City Attorney Don Freeman outlined the process for the evening’s meeting. He explained that Option F, as outlined in the staff report (sale for single-family use only), was not a viable option and that Council would only consider Options A-E.

Mayor McCloud opened the appearances section to public comment at 4:41 p.m.

Joyce Stevens, Melanie Billig, and Robert Knight addressed Council.

Brian Roseth, Principal of Monterey Bay Planning Services, noted that the team of legal, environmental and planning experts had reviewed the public’s written and oral comments. Denise Duffy, EIR Consultant for the City, spoke to the comments, both written and oral submitted by the public, the impacts and mitigation measures.

Council Member ROSE moved adoption of a Resolution Certifying the Re-circulated

seconded by Council Member HAZDOVAC and carried by the following roll call:

Council Member ROSE moved adoption of a Resolution Adopting a Mitigation

Restrictions to Be Recorded against the Property, and Conditions of Lease; a
Resolution Adopting a Statement of Overriding Considerations; and a Resolution
Adopting a Project for Implementation: Sale of Flanders Mansion Parcel with
Conservation Easements and Mitigation., seconded by Council Member SHARP and
carried by the following roll call:

Against Sale of Public Park Land for Tuesday, June 16, 2009, at 4:30 p.m., seconded
by Council Member HAZDOVAC and carried by the following roll call:
