Name: Consideration of a Resolution authorizing the closure of Mission Street between
Ocean and Sixth Avenues between 7:00 am on October 10, 2009, ending 6:00 pm on October 11, 2009 to display and sell handicrafts and other merchandise at events connected with the Carmel Art and Film Festival.

Description: The organizers of the Carmel Art and Film Festival have requested that
Mission Street between Ocean and Sixth Avenues be closed from 7:00 am on Saturday,
October 10th, through 6:00 pm on Sunday, October 11th to set up tents to display and sell art, handicrafts and other merchandise.

Staff Recommendation: Staff recommends Council approve this Resolution.

Important Considerations: The Carmel Art and Film Festival is affiliated with
International Contemporary Art Association, a nonprofit organization supporting and funding educational art programs. The Festival organizers hope to raise money for five art scholarships for Carmel High School students.

Carmel Municipal Code Section 12.32.060 requires that City Council approve the closure of streets and the placement of tents in the public right-of-way for events. This has not posed problems or generated complaints at similar events held in the City in recent years. Chapter 17.14.070 of the Municipal Code allows the Planning Director to grant permission for the outdoor sale of arts, handicrafts and other merchandise for temporary events.

Decision Record: This is the first Carmel Art and Film Festival, so there is no record of previous decisions regarding this event. Resolutions 2006-22 (passed May 2006) and 2009-28 (passed May 2009) approved the closure of Mission Street between Ocean and 6th and the erection of tents for a similar type of event, the Carmel Art Festival.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA APPROVING THE CLOSURE OF MISSION STREET BETWEEN OCEAN AND SIXTH AVENUES FROM 7:00 AM ON OCTOBER 10,
2009 THROUGH 6:00 PM ON OCTOBER 11, 2009 TO DISPLAY AND SELL ARTWORK, HANDICRAFTS AND OTHER MERCHANDISE FOR EVENTS CONNECTED WITH THE CARMEL ART AND FILM FESTIVAL

WHEREAS, the Carmel Art and Film Festival has applied for a Special Event Permit to
host a two-day event on October 10-11, 2009; and

WHEREAS, the Carmel Art and Film Festival requests the closure of Mission Street
between 6th Avenue and Ocean Avenue from 7:00 am on Saturday, October 10, 2009 through 6:00 pm on Sunday, October 11, 2009 for the purpose of erecting 10’x 10’ tents to sell and display artwork, handicrafts and other merchandise; and

WHEREAS, the event venues will include Devendorf Park and surrounding City streets;
and

WHEREAS, profits from the annual Carmel Art and Film Festival will go toward funding
art scholarships for local high school students;

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA DOES:
1. Authorize the closure of Mission Street between 6th and Ocean Avenues from 7:00
am on Saturday, October 10, 2009 through 6:00 pm on Sunday, October 11, 2009.

2. Authorize the erection of 10’x10’ tents on Mission Street between 6th Avenue and
Ocean during this period of time for the purpose of selling and displaying artwork,
handicrafts and other merchandise during the event.
