III. TOUR OF INSPECTION
Shortly after 2:45 p.m. the Commission will leave the Council Chambers for an on-site Tour of Inspection of all properties listed on this agenda (including those on the Consent Agenda). The Tour may also include projects previously approved by the City and not on this agenda. Prior to the beginning of the Tour of Inspection, the Commission may eliminate one or more on-site visits. The public is welcome to follow the Commission on its tour of the determined sites. The Commission will return to the Council Chambers at 4:00 p.m. or as soon thereafter as possible.

The Planning Commission toured the following sites: Ungaretti, Old Mill Properties, Carmel Mission and Henke.

Marc Wiener, Associate Planner, presented the staff report. Chair Reimers opened the public hearing at 4:19 p.m. Greg Holdren and Monte Miller appeared before the Commission. There being no other appearances, the public hearing was closed at 4:20 p.m.
After further discussion, the public hearing was re-opened at 4:26 p.m. Greg Hodren and Judi Henke appeared before the Commission. There being no other appearances, the public hearing was closed at 4:30 p.m.
After further discussion, the public hearing was re-opened at 4:31. Roberta Miller appeared before the Commissioner. There being no other appearances, the public hearing was closed at 4:33 p.m.
Commissioner BEACH moved to approve the project with staff’s Special Conditions #1, #2, #3, #5 and change to #4 – The applicant shall remove two of the skylights at the front of the residence; The three skylights on the living room shall be removed, seconded by DALLAS and carried by the following roll call vote:

Commissioner Reimers re-cused herself from the discussion.
Marc Wiener, Associate Planner, presented the staff report. Vice-chair Hillyard opened the public hearing at 4:44 p.m. Eric Miller, Niels Reimers, Barbara Livingston, Jim Bell and Gunnar Reimers appeared before the Commission. There being no other appearances the public hearing was closed at 5:15 p.m.
After further discussion, the public hearing was re-opened at 5:38 p.m. Niels Reimers, Eric Miller, Barbara Livingston and Jim Bell appeared before the Commission. There being no other appearances, the public hearing was closed at 5:45 p.m.
Commissioner BEACH moved to deny the application based on enforcement of R-1 regulations in Residential-Commercial (RC) district per 17.14.110, seconded by DALLAS and carried by the following roll call vote:
AYES: Beach, Dallas, Hillyard
NOES: Paterson
ABSENT: None
ABSTAIN: Reimers

Due to the similarity with the previous project, DS 10-24, no staff report was given.
Vice-chair Hillyard opened the public hearing at 5:54 p.m. Jim Bell and Catherine Bell appeared before the Commission. There being no other appearances, the public hearing was closed at 5:56 p.m.
Commissioner PATERSON moved to deny the application, seconded by BEACH and carried by the following roll call vote:

Consideration of Design Study, Demolition Permit and Coastal Development Permit application for the demolition of an existing residence and the construction of a new residence located in the Single Family Residential (R-1) District.
Marc Wiener, Associate Planner, presented the staff report. Chair Reimers opened the public hearing at 6:02 p.m. Neil Kruse, Janice Block, Michael LePage and Liz Logan Rendall appeared before the Commission. There being no other appearances, the public hearing was closed at 6:18 p.m.
Commissioner HILLYARD moved to approve the application with staff’s Special Conditions #2, #3, #4, change to #1 – The applicant shall replace the front entry wall with a wood or iron guardrail; The applicant shall revise the design of the front entry so that it is similar to the original proposal; and addition of Special Condition #5 – The applicant shall relocate the skylight above the kitchen to the north side of the roof. Staff’s Finding #5 shall be changed – The applicant is proposing a three foot front setback and a six and–a-half foot second-story rear setback, both of which require the approval of a variance; The applicant is proposing a three foot front setback and a six and-a-half foot second-story rear setback, both of which require the approval of a variance, in addition to the front entry with a zero setback, seconded by PATERSON and carried by the following roll call vote:
Before the vote a member of the audience requested to make a comment. Chair Reimers re-opened the public hearing at 6:27 p.m. Janice Block appeared before the Commission. There being no other appearances, the public hearing was closed at 6:27 p.m.

XI. DISCUSSION ITEMS
1. Consideration of polity regarding wine tasting businesses in the City of Carmel-by-the-Sea.
Sean Conroy, Planning & Building Services Manager, presented the staff report. Chair Reimers opened the public hearing at 6:34 p.m. John Sapp, Michael Lynch, Barbara Livingston, Monte Miller and Vicki Lynch appeared before the Commission. There being no other appearances, the public hearing was closed at 6:46 p.m.
As this was a discussion item, no motion was required.
2. Discussion of the City’s Volumetric Requirements. The Commission may make recommendations to the Council on this item.
Sean Conroy, Planning & Building Services Manager, presented the staff report. Chair Reimers opened the public hearing at 7:17 p.m. There being no other appearances, the public hearing was closed at 7:17 p.m.
Commissioner PATERSON moved to rescind previous recommendation to Council and stay with current Volumetric standards, seconded by DALLAS and failed by the following roll call vote:
AYES: Dallas, Paterson
NOES: Beach, Hillyard, Reimers
ABSENT: None
ABSTAIN: None
Commissioner PATERSON moved to hold decision to send recommendation to Council for twelve (12) months, request staff to keep a log of approved projects and how they perform in volume study, seconded by DALLAS and carried by the following roll call vote:
AYES: Beach, Dallas, Paterson, Hillyard, Reimers
NOES: None
ABSENT: None
ABSTAIN: None
