Name: Consideration of an Ordinance rescinding Ordinance 2006-04 and establishing a standing Traffic Safety Committee (First Reading)

Description: In July 2002, the City Council adopted Ordinance 2002-02, establishing the Community Traffic Safety Commission. This Ordinance was rescinded some four years later, in December 2006, by Ordinance 2006-04. While the basic mission of the new Commission remained the same as before-focusing on traffic safety and parking issues -- the new Community Traffic Safety Commission was changed to ad hoc status, with the number of members reduced from five to four, and with slightly different makeup of
members: one from the Council, one from the Planning Commission, and one member
at-large, in addition to the Public Safety Director. The previous Community Traffic
Safety Commission had been composed of four City residents and a fifth that could be a
member of the business community or from the City's Sphere of lnfluence.
By definition, an ad hoc Committee is intended to focus on one issue and be limited in
the length oftime it exists. As there are many different traffic-related issues that will
face Carmel-by-the-Sea in the future, it appears sensible to reinstate the Traffic Safety
Committee as an ongoing, standing Committee of the City.
Overall Cost: N/ A
Staff Recommendation: Adopt the Ordinance upon first reading.
Important Considerations: As proposed, the Traffic Safety Committee will continue to meet on an
as-needed basis, but as a standing Committee, it will hold its meetings in accordance with the
Brown Act. The City Attorney has reviewed the Ordinance.
Decision Record: Ordinance 2002-02 (July 2, 2002), establishing the Community Traffic Safety
Commission; Ordinance 2006-04 (December 5, 2006) rescinding the previous Ordinance.

RECOMMENDED MOTION
Adopt an Ordinance, upon first reading, rescinding Ordinance 2006-04 and establishing a
standing Traffic Safety Committee.
BACKGROUND
In 2002, the City’s Community Traffic Safety Commission first was established by
Ordinance 2002-02 and codified as Title 2, Chapter 2.39.
At the City Council meeting of October 3, 2006, Council voted to rescind Title 2, Chapter
2.39 and reconstitute the Community Traffic Safety Commission as an ad hoc Council
Traffic Committee, and at the December 5, 2006 meeting, Ordinance 2006-04 was
adopted, rescinding this Chapter of the Municipal Code.
Under the guidelines established in 2006, the ad hoc Traffic and Safety Committee had
the following requirements: that its members consist of a member from the City Council,
a member of the Planning Commission, a member of the public at-large nominated by the
Mayor and ratified by the majority of the Council, and the Public Safety Director; that the
Committee meet on an as-needed basis depending on the number of traffic and safety
issues; that the City Council review the decisions of the Traffic Committee at a regular
City Council meeting when policy direction was needed or a decision required an
expenditure in excess of $5,000; and that the Committee give periodic reports to the City
Council of actions taken.
STAFF REVIEW
Ad hoc Committees, by definition, are meant to focus on one issue and/or be time-limited.
With many traffic-related issues that likely will face the City, it is recommended that the
Traffic Safety Commission be reinstated as a standing committee and codified as such in the
Municipal Code. As proposed, the Traffic Safety Committee will continue to meet on an asneeded
basis, but as a standing Committee, will hold its meetings in accordance with the Brown
Act.

FISCAL IMPACT
There will be some fiscal impact associated with creating this standing Committee as
staff time will be added to create and post agendas and develop staff reports. In addition,
unlike before, meetings must now be held and recorded in the Council Chambers.

AND ESTABLISHING A STANDING TRAFFIC SAFETY COMMITTEE
WHEREAS, the purpose of the Traffic Safety Commission is to address traffic-related
issues and concerns within the City and its Sphere of Influence and to advise Council; and
WHEREAS, the City’s Traffic Safety Commission was established as an ad hoc Committee
of the Council by City Council Ordinance 2006-04 in December 2006; and
WHEREAS, the City previously had a Community Traffic Safety Commission which was
codified in the Municipal Code as Title 2, Chapter 2.39; and
WHEREAS, by definition, an ad hoc Committee is intended to focus only on limited set of
issues and be in existence for a short duration; and
WHEREAS, with the many traffic issues that likely will face the City in the future, it is
prudent to reconstitute the Committee on a long-term, standing basis.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
DOES HEREBY ORDAIN AS FOLLOWS:
Section One. That Title 2, Chapter 2.39 Traffic Safety Committee is hereby reinstated as
shown in Exhibit “A”.
Section Two. All Ordinances and parts of Ordinances in conflict herewith are hereby
rescinded.
Section Three. Effective Date. This Ordinance shall take be in full force and effect
thirty (30) days from and after its final passage and adoption.

2.39.010 Establishment and Purpose of Committee
There is created and established the Traffic Safety Committee of the City of Carmel-by-the-Sea.
The purpose of the Committee is to provide the Council with recommendations on traffic safety
policies and programs related to the movement and parking of vehicles within the City and its
Sphere of Influence.
2.39.020 Membership and Criteria for Appointment
The Committee shall consist of four members, each of them to be appointed by the Council.
These members shall include: the Public Safety Director; one member of the City Council; one
member of the Planning Commission, and one City resident at-large who has interest in or
familiarity with traffic safety issues.
2.39.030 Appointment Process
Members of the Traffic Safety Committee shall be nominated by the Mayor and ratified by at least
three of the five members of the City Council.
2.39.040 Meetings
The Committee shall meet on an as-needed basis. Meetings will be held in accordance with the
Ralph M. Brown Act.
2.39.040 Duties, Responsibilities, and Authority
The Traffic Safety Committee shall have the following duties, responsibilities, and authority:
A. To maximize traffic safety within the City.
B. To develop rules and regulations for conducting its business and meetings in accordance
with the laws of the State and the City.
C. To, on its own initiative, or at the request of the City Council or the City Administrator,
make such recommendations to the City Council and the City Administrator concerning
traffic-related activities and programs as may be deemed appropriate.

D. To advise and assist the City Council and, when requested or on its own initiative, other
City board and commissions, departments and City residents, on traffic-related programs.
E. To initiate traffic programs and projects.
F. To remain cognizant at all times of traffic problems and conditions in the City and endeavor
to put resources to their best possible use.
G. To review, upon request of the City Council, traffic-related programs, benefits or services.
H. To hear citizen’s traffic-related requests and concerns, evaluate them, and when appropriate,
recommend solutions to the City Council.
I. To provide long-term planning and analysis and make recommendations for dealing with
future traffic issues.
J. To provide ongoing public information and education on traffic-related topics and increase
the general public’s awareness of local traffic issues.
K. The Traffic and Safety Committee will, as needed, seek the policy direction of the City
Council at a regular meeting or when a decision of the Committee would require an
expenditure in excess of $5,000.
