Name: Consideration of a Resolution entering into an agreement with Denise Duffy & Associates to prepare an environmental impact report (EIR) in accordance with the California Environmental Quality Act (CEQA) for the Flanders property in an amount not to exceed $67,000.

Description: Denise Duffy & Associates will prepare an EIR using existing information on the property and from the Flanders Property Final EIR, dated August 2005.

The scope of work will include: defining parameters for project description; preparing an administrative draft of the EIR for comment by staff; preparing a draft EIR for public circulation; preparing responses to comments on the draft EIR; and attending public hearings.

City Funds: $67,000
Grant Funds: N/A

Staff Recommendation: Adopt the Resolution.

Important Considerations: It is important to prepare this EIR to provide a comprehensive project description and, list all the appropriate project objectives and alternatives that are required under CEQA.

Decision Record: Adopted Resolution No. 2004-86 approving an agreement with Denise Duffy & Associates to prepare an EIR. Adopted Resolution No. 2007-71 decertifying the EIR for the Sale of Flanders Property.

RESOLUTION NO. 2008-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA ENTERING INTO AN AGREEMENT WITH DENISE DUFFY & ASSOCIATES TO PREPARE AN ENVIRONMENTAL IMPACT REPORT FOR THE FLANDERS PROPERTY

WHEREAS, Denise Duffy & Associates (DDA) is a qualified environmental firm that prepares Environmental Impact Reports;

WHEREAS, the City desires to hire DDA to prepare a new EIR in accordance with the California Environmental Quality Act;

WHEREAS, DDA is familiar with the Flanders property and will provide continuity in preparing a new draft EIR;

WHEREAS, DDA has submitted a proposal to prepare a new draft EIR that will include additional information that wasn’t part of the rescinded EIR.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA DOES:

1. Entering into an agreement with DDA to prepare an EIR for the Flanders property in an amount not to exceed $67,000.

2. Authorize payment for the professional services rendered in the agreement from account no. 01-69051.
