II. TOUR OF INSPECTION
Shortly after 2:30 p.m. the Commission will leave the Council Chambers for an on-site Tour of Inspection of all properties listed on this agenda (including those on the Consent Agenda). The Tour may also include projects previously approved by the City and not on this agenda. Prior to the beginning of the Tour of Inspection, the Commission may eliminate one or more on-site visits. The public is welcome to follow the Commission on its tour of the determined sites. The Commission will return to the Council Chambers at 4:00 p.m. or as soon thereafter as possible.

The Planning Commission toured the following sites: Del Mar Beach, Lambert, Walker, Biason, Carmel Plaza, Pepe, Sangerman & Gilfilan.

Sean Conroy, Planning & Building Services Manager, made the following announcements:
1. Chair Reimers absent from today’s meeting, Vice-Chair Hillyard would be chairing the meeting.
2. 2 appeals to City Council – the project for vinyl windows on Lasuen was over-turned and allowed for vinyl windows everywhere except the front windows; the Mission Domicile project appeal was upheld and the garage shall be pushed back 3’.
3. Consent Agenda item #3 – Forest & Beach Commission approved a 6-month trial period.

Vice-chair Hillyard opened the public hearing at 4:18 p.m. Rich Pepe, Barbara Livingston and Constance Dudley appeared before the Commission. There being no other appearances, the public hearing was closed at 4:26 p.m.
Commissioner PATERSON moved to approve the application with staff’s Special Conditions and addition of Special Condition #18 – The outdoor seating shall not impede public access to the courtyard and historic statue. Outdoor seating shall be limited to a maximum of 16 seats and no more than three tables. The tables shall be located towards the south side of the courtyard entrance on Dolores Street and the south side of the courtyard, seconded by DALLAS and carried by the following roll call vote:

Commissioner PATERSON moved to approve the application with staff’s Special Conditions #1-16 and change to Special Condition #17 - The applicant shall submit a final floor plan to the City identifying the number of seats proposed in each space and the total number proposed for the restaurant prior to operation indicating that no more than 49 seats are proposed, seconded by DALLAS and carried by the following roll call vote:

Vice-chair Hillyard opened the public hearing at 4:59 p.m. David Fink, Denny Levett, Monta Potter, Bill Hill, Peter Baird, Lisa Diaz, Jim Griffith, Barbara Livingston, Constance Dudley and Richard Pepe appeared before the Commission. There being no other appearances, the public hearing was closed at 5:54 p.m.
After further discussion the public hearing was re-opened at 6:20 p.m. Lisa Diaz, David Fink and Constance Dudley appeared before the Commission. There being no other appearances, the public hearing was closed at 6:24 p.m.
Commissioner BEACH moved to approve the application with staff’s Special Conditions #1-16 and #19; deletion of #17 - The applicant shall revise the plans to eliminate the proposal to enclose the existing breezeway. No increase in floor area is authorized; change to #18 - The applicant shall work with staff to revise the railing design for the outdoor seating area and will include planters along the south and west retaining walls; and addition of Finding #8 - The applicant shall be permitted to infill the existing breezeway as it had previously been part of the enclosed floor area, will not add to the mass and bulk of the plaza and will be offset by the reduction of mezzanine floor area that is proposed for removal, seconded by PATERSON and carried by the following roll call vote:

Marc Wiener, Associate Planner, presented the staff report. Vice-chair Hillyard opened the public hearing at 7:11 p.m. Dana Annereau appeared before the Commission. There being no other appearances, the public hearing was closed at 7:18 p.m.
Commissioner HILLYARD moved to approve the application with staff’s Special Condition #1; change to #2 - The applicant shall provide a detailed landscape plan to be reviewed by staff and the City Forester prior to the issuance of a building permit. Details of the front fence shall be provided on the landscape plan. The hedges at the front of the property shall be retained; addition of Special Condition #3 - The applicant shall lower the height of the front window by eight inches; addition of Special Condition #4 – The aplicant shall reduce the portion of the deck in front of the dining room to a width of three feet; and addition of Special Condition #5 - The applicant shall use unclad wood windows, seconded by BEACH and carried by the following roll call vote:
